Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Chosin Few Memorial Walk digital memorial and educational platform, located at chosinfew.org and chosinfewmemorialwalk.org (the “Site”), which is operated by Chosin Reservoir: The March of the Chosin Few (the “Organization,” “we,” “us,” or “our”), a 501(c)(3) nonprofit organization.

By accessing, browsing, or contributing to the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site.

Description of Services

The Site provides the following services to the public free of charge:

  • A digital memorial honoring the service members who fought at the Battle of Chosin Reservoir;
  • Educational content about the campaign, including engagements, a timeline, and an interactive map;
  • A tribute system allowing visitors to submit remembrances for review and publication;
  • A “Walk the March” memorial challenge that lets participants track walking mileage and progress toward milestones;
  • Information about events, educational resources, and opportunities to support the Organization.

We may modify, suspend, or discontinue any part of the Site at any time without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuance.

User Accounts

Certain features — such as submitting a tribute and participating in the Walk the March challenge — require you to create an account through our secure authentication system.

  • You agree to provide accurate and complete information when registering;
  • You are responsible for safeguarding your account credentials and for all activity under your account;
  • You must be at least 13 years of age to create an account. Users under 18 should participate with the involvement of a parent or guardian;
  • You agree to notify us immediately of any unauthorized use of your account.

Tribute Submissions and Content Moderation

The Site allows visitors to submit tributes honoring service members. To preserve the dignity of this memorial, all tributes are reviewed by our moderators before they appear publicly.

  • We reserve the right to edit, decline, or remove any tribute at our discretion, without notice;
  • Tributes must be respectful, accurate to the best of your knowledge, and may not contain commercial, defamatory, or inappropriate content;
  • By submitting a tribute, you confirm that you have the right to share any text or photographs you include, and that the content does not infringe the rights of any third party;
  • You may request removal or correction of a tribute you submitted by contacting us.

User-Generated Content License

When you submit content to the Site — including tributes, photographs, walk entries, or contact messages — you grant the Organization a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute that content on and in connection with the Site and our educational and commemorative mission.

You retain ownership of your content. You represent that you have all necessary rights to grant this license and that your content complies with these Terms and applicable law.

Walk the March Participation

The Walk the March challenge is a voluntary, self-directed fitness activity intended to honor the Chosin Few. By participating, you acknowledge that:

  • You participate at your own risk and are responsible for your own health and safety;
  • The Organization provides the challenge for commemorative and motivational purposes only and does not provide medical advice or supervision;
  • You should consult a physician before beginning any new physical activity;
  • Mileage and progress you log may be displayed publicly if you choose to share it; you may also keep your entries private.

Donations

The Site facilitates charitable contributions through our third-party donation processor, Zeffy. Donations to the Organization are tax-deductible to the extent allowed by law as contributions to a 501(c)(3) organization.

Payment processing is handled solely by Zeffy, and the Organization does not collect or store your payment card information. Any dispute regarding a transaction should be directed to Zeffy and to us at the contact information below. We reserve the right to decline or refund contributions at our discretion.

Intellectual Property

The Site’s content — including text, historical narratives, images, graphics, logos, and design — is owned by or licensed to the Organization and is protected by copyright and other intellectual property laws. Content is provided for educational and commemorative purposes.

You may view and use the Site for personal, educational, and non-commercial purposes. Reproduction, redistribution, or public display of Site content beyond reasonable personal or classroom educational use requires written permission from the Organization.

Prohibited Conduct

You agree not to use the Site to:

  • Submit content that is unlawful, harmful, defamatory, harassing, hateful, or otherwise inappropriate for a memorial honoring fallen service members;
  • Impersonate any person or entity, or misrepresent your affiliation;
  • Upload content that infringes the copyright, privacy, or other rights of any third party;
  • Attempt to gain unauthorized access to the Site, its systems, or another user’s account;
  • Use automated means to collect data from the Site or interfere with its operation;
  • Engage in any commercial solicitation or advertising through the Site without our permission.

We may suspend or terminate access for any user who violates these Terms.

Third-Party Links and Services

The Site contains links to external websites, including partner organizations and the official Chosin Few organization at chosinfew.org and chosinfewmemorialwalk.org. We do not control and are not responsible for the content, policies, or practices of third-party sites. Your use of third-party sites is at your own risk.

Disclaimers and Limitation of Liability

The Site is provided “as is” and “as available” for educational and commemorative purposes. While we strive for historical accuracy, we make no warranties regarding the completeness or accuracy of all content, and we may rely on contributed or third-party historical material.

To the fullest extent permitted by law, the Organization and its officers, directors, volunteers, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, the Site. Because the Organization is a nonprofit providing free services, your sole remedy for dissatisfaction is to stop using the Site.

Indemnification

You agree to indemnify and hold harmless the Organization and its officers, directors, volunteers, and agents from any claims, damages, or expenses (including reasonable legal fees) arising out of content you submit, your violation of these Terms, or your infringement of any third-party rights.

Privacy

Our handling of personal information is described in our Privacy Policy, available on the Site. Your use of the Site is also governed by that policy, which is incorporated into these Terms by reference.

Changes to These Terms

We may revise these Terms from time to time. We will post the updated Terms on this page and revise the “last updated” date at the top. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law principles. Any disputes arising from these Terms or your use of the Site will be resolved in the courts located in Beaufort County, South Carolina.
